"content": "<p>Le personnel ayant 1 an de présence a droit à un congé annuel minimum de 5 semaines. La durée des congés payés est exprimée en jours ouvrés, soit 25 jours ouvrés pour l'année (ou 30 jours ouvrables).</p><p>L'année de référence est la période comprise entre le 1er juin de l'année précédente et le 31 mai de l'année en cours.</p><p>Le calcul de l'indemnité de congé payé est égal à 1 / 10 de la rémunération totale perçue par le salarié au cours de la période de référence, sans toutefois être inférieur à la rémunération que le salarié aurait perçue s'il avait travaillé pendant sa période de congés.</p><p>Délai de prévenance</p><p>La période des congés doit être fixée par l'employeur le 1er mars de l'année de référence et l'ordre des départs le 1er avril de l'année de référence.</p><p>La période de congé principal d'une durée continue supérieure à 10 jours ouvrés (ou 12 jours ouvrables) et, au plus, égale à 20 jours ouvrés (ou 24 jours ouvrables) doit obligatoirement être accordée pendant la période du 1er mai au 31 octobre.</p><p>Toutefois, la durée des congés pouvant être pris en une seule fois peut excéder 20 jours ouvrés (ou 24 jours ouvrables).</p><p>Les délégués du personnel seront informés par écrit des prévisions de la direction sur les modalités des départs en congés.</p><p>En conséquence, afin de favoriser la vie familiale des salariés, les 5 jours ouvrés restants (ou 6 jours ouvrables) ― soit la 5e semaine ― seront pris pendant la période du 1er novembre au 31 mai et pour les salariés qui en feront la demande pendant une période de congés scolaires (Noël, février, Pâques).</p><p>Le personnel appelé pendant ses congés à rejoindre son lieu de travail le fera aux frais de son employeur. Le retour au lieu de congé se fera dans les mêmes conditions.</p><p>Les employeurs déclarent à la caisse de congés payés le personnel artistique et technique qu'ils n'ont pas employé de façon continue pendant les douze mois précédant la demande de congé en application de l'article D. 7121-41. Ils s'acquittent de leurs obligations vis-à-vis de ces personnels en versant la cotisation prévue aux articles D. 7121-35 et D. 7121-44 du code du travail.</p>",
