Le notaire du propriétaire doit transmettre à la Safer une déclaration d'intention d'aliéner : - par lettre recommandée avec accusé de réception - ou par acte d'huissier de justice spécifiant la nature et la localisation du bien, les noms et qualités de l'acquéreur et du vendeur, ainsi que le prix de vente. Le notaire doit aussi informer : - la mairie de la commune où se situe le terrain de son intention de vendre - et la Safer de l'existence du droit de préemption prioritaire de la commune. La Safer doit informer le maire des projets de vente de biens situés sur le territoire de sa commune. Attention : toute vente d'un fonds agricole effectuée sans notification préalable de la Safer peut être annulée avec des dommages-intérêts à verser."
