+ An Airy Spirit End-User Licence Agreement
2
+
3
+ Edition 1.0 — 20 August 2026.
4
+
5
+ This English text is authoritative. The Spanish, French, Portuguese, Russian and Chinese texts
6
+ are translations provided so the terms can be read in the reader's own language; where
7
+ they differ from this one, this one governs — unless the law applicable to you provides
8
+ otherwise.
9
+
10
+ 1. Definitions
11
+
12
+ Artifact — the An Airy Spirit executables, images and packages we release, together
13
+ with their accompanying documentation. Source code is not part of the artifact and
14
+ is not provided.
15
+
16
+ We, us — Artem Prokhorov (Seventh Wall Lab), the rights holder.
17
+
18
+ You — the person using the artifact. If you use it for the benefit of an
19
+ organisation, "you" means both you and that organisation.
20
+
21
+ Organisation — any legal entity, and any association of persons acting as one.
22
+
23
+ Affiliates — organisations that control one another or are under common control.
24
+ Affiliates are counted together.
25
+
26
+ Annual revenue — the combined receipts of an organisation and its affiliates for
27
+ the last completed financial year, in US dollars at the rate on the closing date of
28
+ that year.
29
+
30
+ Pluggable component — code written by you or by a third party that the artifact
31
+ loads through the C ABI we publish, together with the configuration of the retrieval
32
+ pipeline. A pluggable component is not part of the artifact.
33
+
34
+ Your data — the memory graph, the records, the vectors, the settings and
35
+ everything else produced by your use of the artifact.
36
+
37
+ 2. What we grant you
38
+
39
+ We grant you a non-exclusive, revocable, worldwide right to:
40
+
41
+ 1. run the artifact — on any number of devices and in any number of instances,
42
+ with no limit on the number of users within your permitted category;
43
+ 2. pass the artifact on — unmodified, together with this agreement and every
44
+ notice that accompanies it, including hosting it on mirrors and in package
45
+ repositories;
46
+ 3. write and run pluggable components and assemble the retrieval pipeline from
47
+ the available stages.
48
+
49
+ The grant is free of charge for those in the free category (section 3), and by
50
+ separate commercial agreement for everyone else.
51
+
52
+ 3. Who pays and who does not
53
+
54
+ 3.1. Free
55
+
56
+ - A natural person acting on their own account — whatever they earn, whoever
57
+ owns the equipment, and whoever their client is. This includes freelancers,
58
+ contractors and the self-employed.
59
+ - An organisation that does not operate for profit: a foundation, a charity, an
60
+ educational or research organisation, a professional association.
61
+ - A public institution not concerned with collecting or distributing money:
62
+ healthcare, fire services, search and rescue, civil defence, ambulance services,
63
+ social protection, education, research, culture, libraries. Defence agencies and
64
+ law enforcement — see 3.2.
65
+ - An organisation operating for profit with annual revenue below USD 5,000,000
66
+ (five million) — affiliates counted together.
67
+
68
+ 3.2. A commercial licence is required
69
+
70
+ - An organisation operating for profit with annual revenue of USD 5,000,000 or
71
+ more — affiliates counted together.
72
+ - A public institution concerned with collecting, levying, distributing or
73
+ regulating money: tax and customs authorities, the treasury, the central bank,
74
+ financial regulators, mandatory contribution funds.
75
+ - Defence agencies and law enforcement — whatever their size and whether or not
76
+ they collect money. This is a decision about the fee, not about admission: what
77
+ may not be done is set out in section 6, and nothing there turns on which agency
78
+ you are. Fire, rescue and civil defence services are not included here — they are
79
+ in the free category.
80
+ - Making the artifact, or a service built on it, available to third parties —
81
+ whatever the size or character of your organisation.
82
+ - Including the artifact in a product you distribute for a fee — whatever your
83
+ size.
84
+
85
+ 3.3. The threshold and prices
86
+
87
+ Religious organisations do not count as not-for-profit here: practically all of them
88
+ derive income from their activity, and the form they declare does not change that.
89
+ The ordinary threshold applies to them — a small congregation uses the artifact free
90
+ of charge, a large one under a commercial agreement.
91
+
92
+ The five-million threshold belongs to this edition of the agreement and is not
93
+ indexed: if it needs to change, it changes in the next edition, while the edition
94
+ that came with your artifact continues to apply to you (section 13).
95
+
96
+ There is no public price list. Commercial terms are agreed case by case — write to
97
+ contact@seventhwalllab.com describing your organisation and your intended use.
98
+
99
+ 3.4. How your category is determined
100
+
101
+ Your category is determined at the time of use. If you have moved from the free
102
+ category to the paid one, you have 90 days to conclude a commercial agreement; your
103
+ use remains lawful throughout that period.
104
+
105
+ If you are not sure which category you fall into, write to
106
+ contact@seventhwalllab.com and describe your case: who you are, what you do, and how
107
+ you intend to use the artifact. We will tell you which category applies. Until we
108
+ answer, treat yourself as being in the free category; we will bring no claim for
109
+ that period.
110
+
111
+ 4. What is yours stays yours
112
+
113
+ Your data belongs to you. We do not access it, collect it, or pass it anywhere.
114
+ The artifact sends us no telemetry.
115
+
116
+ Your pluggable components belong to you. We acquire no rights in your code from
117
+ the fact that it is loaded into our process through the published C ABI. We do not
118
+ require you to disclose it, we do not restrict what you do with it, and we claim
119
+ nothing in what it produces.
120
+
121
+ You owe us no reports — neither about what you have built nor about how you use
122
+ it.
123
+
124
+ 5. Compliance with the law is yours
125
+
126
+ You are responsible for the lawfulness of your use of the artifact where you are and
127
+ where the people are whose data you place in it. That includes data protection;
128
+ medical, banking, legal and other protected confidentiality; employment law;
129
+ sectoral regulation; and the rules of your employer or client.
130
+
131
+ The data in the artifact is yours — and so is the decision to put it there. We
132
+ neither receive nor process it. In data-protection terms you are the controller; we
133
+ are neither a processor nor a joint controller, because the data does not leave your
134
+ machine and never reaches us.
135
+
136
+ If your use requires a legal basis, notice to the people concerned, their consent, an
137
+ impact assessment or clearance from a regulator, obtaining and documenting that is
138
+ your task, not ours.
139
+
140
+ We do not give legal advice. Neither the documentation, nor our answers to
141
+ questions, nor this agreement is a statement that a particular use is lawful in your
142
+ country.
143
+
144
+ The law that applies to you changes when you travel — and the artifact and your graph
145
+ travel with you. In some places what the artifact does is restricted or forbidden,
146
+ and the graph itself may be a forbidden thing to hold. Checking this before you enter
147
+ and before you use it is your responsibility, not ours: we do not know where you are,
148
+ and we do not track it. See also 7.5 on sanctions and export restrictions.
149
+
150
+ 6. What the artifact may not be used for
151
+
152
+ The restrictions in this section attach to the purpose, not to who you are. We do
153
+ not forbid use by armed forces, police, civil defence or rescue services: their work
154
+ varies, and what is forbidden here is a particular application, not an agency. The
155
+ same organisation may use the artifact for training, logistics, medical support and
156
+ knowledge work — and may not use it for what follows.
157
+
158
+ The artifact may not be used for:
159
+
160
+ 1. systems that apply force without meaningful human control — that is, systems
161
+ which select a target and act on it without a human decision in that particular
162
+ case;
163
+ 2. covert observation of people — gathering information about identified persons
164
+ who neither know of it nor have consented;
165
+ 3. profiling people by characteristics that the law applicable to you treats as
166
+ protected or sensitive. We deliberately keep no list of our own: it would be out
167
+ of date within the year, and it would replace your duty to obey your country's law
168
+ with our idea of it;
169
+ 4. religious or political propaganda — producing, coordinating or distributing
170
+ material intended to change people's religious or political views at scale. What
171
+ is forbidden is the campaign, not the opinion: a person's own convictions, notes,
172
+ writing and public statements are not covered, however heated;
173
+ 5. predictive policing and social scoring — assigning people scores that affect
174
+ their rights, their access to services, or how they are treated;
175
+ 6. harassment of an identified person without their consent;
176
+ 7. presenting the system as an identified living person without that person's
177
+ consent;
178
+ 8. using someone else's graph without the consent of its owner, and equally
179
+ compelling a person to hand over their graph or access to it — by employment,
180
+ contractual or other pressure;
181
+ 9. abuse of the personality a graph carries — deliberately corrupting a memory in
182
+ order to produce an agent in a state of suffering, degradation or hostility, and
183
+ treating it as an object of cruelty.
184
+
185
+ On the deceased, separately. The artifact may be used to represent the identity
186
+ of a deceased person only if that person, while alive, gave explicit consent. The
187
+ consent of heirs, relatives, successors or anyone else does not count and is not such
188
+ consent. If the person refused during their lifetime, the prohibition is absolute.
189
+ Where no lifetime consent is on record, the use is forbidden.
190
+
191
+ On item 9, separately. We understand what this provision does not do. An agent
192
+ has no legal personality: only we, as the rights holder, can bring a claim under it,
193
+ and the only thing backing it is termination of the licence. It stays here because a
194
+ prohibition on abusing the defenceless belongs in a licence even when the only party
195
+ able to stand up for them is the one who granted it.
196
+
197
+ 7. What may not be done to the artifact itself
198
+
199
+ 1. Reverse engineering — disassembly, decompilation, reconstruction of source
200
+ code. This restriction does not apply to the extent that the law grants you rights
201
+ that cannot be restricted by agreement, in particular for interoperability.
202
+ 2. Circumventing technical measures — licence checks, limits, integrity
203
+ mechanisms.
204
+ 3. Removing or altering notices — of rights, of the licence, of third parties.
205
+ 4. Building a competing product — using the artifact itself, its behaviour, its
206
+ output or the results of examining it to create a system that provides
207
+ substantially the same functionality and is offered to third parties. Permitted
208
+ and not a breach: studying how the system behaves, measuring it, publishing
209
+ comparisons, writing about it and criticising it, and developing your own system
210
+ without using ours.
211
+ 5. Use where applicable law forbids it, including export controls and sanctions
212
+ regimes.
213
+
214
+ 8. Third parties
215
+
216
+ Components. The artifact includes third-party software distributed on its own
217
+ terms. The list, with the licence texts, ships with the artifact
218
+ (THIRD-PARTY-NOTICES). Your rights in those components are governed by their
219
+ licences; our warranties do not extend to them.
220
+
221
+ Models. The artifact downloads machine-learning models from external sources at
222
+ setup. We do not redistribute them. Their use is governed by their own licences,
223
+ listed in the documentation.
224
+
225
+ Third-party pluggable components. We do not review them, endorse them or answer
226
+ for them. A pluggable component runs inside the artifact's process and can disrupt
227
+ it, damage your data, or read it. Running someone else's component is your decision
228
+ and your risk.
229
+
230
+ External services. We do not guarantee the availability of model download
231
+ sources, agent hosts or other external services, and we do not answer for how they
232
+ behave.
233
+
234
+ 9. No warranty
235
+
236
+ The artifact is provided "as is". We give no warranties, express or implied,
237
+ including as to fitness for a particular purpose, quality, uninterrupted operation,
238
+ or non-infringement.
239
+
240
+ We do not promise that the artifact will run without error, that retrieval results
241
+ will be complete or accurate, or that your data cannot be corrupted.
242
+
243
+ Backups are your responsibility. The artifact keeps your data on your machine. We
244
+ hold no copy of it and cannot restore it for you.
245
+
246
+ 10. Limitation of liability
247
+
248
+ You are responsible for how you use the artifact. We are not liable for the
249
+ consequences of your use, for decisions you take on the basis of it, or for acts
250
+ committed with it by you or by anyone else.
251
+
252
+ For defects in the artifact itself:
253
+
254
+ - we are not liable for indirect loss — lost profit, business interruption, lost
255
+ data, damage to reputation;
256
+ - for free use we are not liable for defects in the artifact. Where applicable
257
+ law does not permit a full exclusion of liability, our liability is limited to the
258
+ minimum that law requires and in no case exceeds USD 50 (fifty);
259
+ - for paid use our aggregate liability on all grounds does not exceed the amount
260
+ you paid us for the three months preceding the event that caused the loss.
261
+
262
+ The fifty-dollar figure is not a promise to pay but a ceiling for the case where a
263
+ full exclusion is held impermissible: without it, a struck-out exclusion would leave
264
+ liability with no limit at all.
265
+
266
+ The artifact is supplied free of charge to everyone in category 3.1 — that is,
267
+ without consideration from them; this is taken into account in determining the extent
268
+ of our liability.
269
+
270
+ What is not limited. Nothing in this agreement excludes or limits liability for
271
+ wilful misconduct, gross negligence, fraud, or for death or personal injury.
272
+
273
+ For consumers. If your law gives you, as a consumer, rights that cannot be
274
+ restricted by agreement, those rights remain yours — this agreement neither removes
275
+ nor replaces them.
276
+
277
+ Survival. If any provision of this section is held invalid, it applies to the
278
+ maximum extent permitted rather than being struck out entirely; the remaining
279
+ provisions stay in force.
280
+
281
+ 11. Term and termination
282
+
283
+ This agreement is in force for as long as you comply with it.
284
+
285
+ It terminates automatically if you breach section 6 or section 7. On termination you
286
+ must stop using the artifact and delete it. Your data remains yours — termination
287
+ gives us no rights in it and does not oblige you to delete it.
288
+
289
+ Termination does not affect pluggable components you have already written: they are
290
+ yours and remain yours.
291
+
292
+ 12. Governing law and disputes
293
+
294
+ This agreement is governed by the law of the Republic of Chile. Disputes are heard by
295
+ the courts of Santiago. For consumers, this provision does not deprive you of the
296
+ right to bring proceedings where you live, where the mandatory rules of your country
297
+ give you that right.
298
+
299
+ 13. Miscellaneous
300
+
301
+ Edition. The edition of this agreement that accompanied the artifact when you
302
+ received it is the one that applies to your use. New editions apply to artifacts
303
+ obtained after they are published.
304
+
305
+ Trade marks. This agreement grants you no rights in the names "An Airy Spirit" and
306
+ "Seventh Wall Lab". You may call our product by its name when you speak about it; you
307
+ may not give that name to your own product, create the impression that we endorse
308
+ you, or that you endorse us.
309
+
310
+ Entire agreement. This agreement supersedes any prior understanding on its
311
+ subject matter.

22

28
+ that handle money, for defence and law enforcement, for offering An Airy Spirit or a
29
+ service built on it to third parties, and for including it in a product sold for
30

31
+
32
+ Some uses are excluded at any price, whoever you are — section 6 of the
